The
Divorce Process
There
are two different types of divorces in Louisiana, A 102 and a
103 Divorce. We offer preparation services for both types of divorce.
Basically the only difference between the two is the period of
time you have been separated from your spouse. If you have been
separated over 6 months, you will do a 103 divorce and if you
have been separated less than 6 months then you will do a 102
divorce.
CC ARTICLE 102 DIVORCE
ACTION STEP 1: The filing party should complete the Petition for
Divorce (Form 1).

2: Both parties should complete the Marital Settlement Agreement
(Form 3), making certain to agree to all of the terms contained
therein.
STEP
3: Petitioner then files Petition and Marital Settlement Agreement
(Forms 1 and 3). A filing fee is paid.
STEP
4: Next, complete and file the Waiver (Form 4) after signed by
the Defendant.
STEP
5: After the required waiting period of one hundred-eighty days
have elapsed, the Petitioner should complete and file the Rule
for Divorce and Order (Form 7) along with the completed Affidavit
(Form 5). The Judge will sign the order setting the hearing date.
The Order is attached to the rule.
STEP
6: Attend Hearing where the Judgment of Divorce (Form 9) will
be submitted at hearing for Judge's signature.

ARTICLE 103 DIVORCE ACTION STEP 1: The filing party should complete

2: Both parties should complete the Marital Settlement Agreement

3: The Petitioner should file the Petition for Divorce and Marital
Settlement Agreement (Forms 2 and 3).

4: The Waiver (Form 4) is then completed and filed after signed
by the Defendant.

5: Petitioner should complete and file the Rule for Divorce and
Order (Form 8) along with the completed Affidavit (Form 6). The
Judge will sign the order setting the hearing date. The Order
is attached to the rule.
STEP
6: Attend Hearing where the Judgment of Divorce (Form 9) will
be submitted at hearing for Judge's signature. Notes: When presenting
Pleadings to the Clerk make sure you have at least 4 copies for
the Clerk. The Clerk will return the copies to you that the Court
does not need. If a Certificate of Mailing is on any form, a copy
of the form should be mailed to the person indicated.
